Terms of service
These are informed draft terms for the Kintry public beta. They are provided for orientation, not as final legal advice. Please review them with counsel before you rely on them.
Provider
The service is operated by Kintry s.r.o., a limited liability company (společnost s ručením omezeným) incorporated in the Czech Republic.
- Company name: Kintry s.r.o.
- IČO (company ID): [to be completed]
- Registered office: [to be completed], Czech Republic
- Terms and DPA contact: [email protected]
In these terms, “Kintry”, “we”, and “us” mean Kintry s.r.o. “You” means the person or organization using the service. By creating an account or using Kintry, you agree to these terms. If you use the service on behalf of an organization, you confirm you are authorized to bind that organization.
The service
Kintry is a business-to-business product operating system offered at app.kintry.io. During the public beta the service is provided free of charge and on an “as available” basis. Beta features are still under active development, so they may change, be added, or be removed at any time, and the service may be interrupted while we work on it.
Accounts
You are responsible for keeping your credentials secure and for activity under your account. Provide accurate information, keep it current, and let us know promptly at [email protected] if you suspect unauthorized access.
Acceptable use
You agree not to misuse the service. In particular, you will not:
- upload or share unlawful, infringing, or harmful content;
- attempt to breach security or access data that is not yours;
- interfere with other workspaces or the operation of the service;
- reverse engineer the service beyond what applicable law permits; or
- use the service to build a competing product.
Customer content and intellectual property
You retain all rights to the content you and your workspace members create inside Kintry, including insights, features, work items, wiki pages, and attachments (your “content”). You grant us a limited, non-exclusive licence to host, store, process, and display your content solely to operate and provide the service to you, and to the extent needed for backups and security.
We retain all rights to the Kintry platform, software, and brand. Nothing in these terms transfers ownership of the service to you. You may not use our name or logo without our prior written consent, except to identify Kintry as a service you use.
AI features
Some features use artificial intelligence. AI outputs may be inaccurate, incomplete, or out of date, so you should review them before relying on them and should not treat them as professional advice.
When you enable AI features, you may add your own AI provider keys to your workspace. Those keys, and any costs, usage limits, and terms of the underlying provider, are your responsibility. We store the keys in encrypted form and use them only to run the AI features you request.
Availability and support
During the beta there is no service level agreement and no guaranteed uptime. We aim to keep the service available and to answer questions at [email protected], but support is provided on a best-effort basis.
Warranties disclaimer
To the extent permitted by Czech law, the beta service is provided “as is” and “as available” without warranties of any kind, whether express or implied, including any implied warranties of merchantability, fitness for a particular purpose, or non-infringement. We do not warrant that the service will be uninterrupted, error free, or secure, or that any content will be preserved without loss.
Limitation of liability
To the extent permitted by Czech law, we are not liable for indirect, incidental, special, or consequential damages, or for lost profits, lost data, or business interruption, arising from your use of the beta service. To the extent our liability can be limited, it is capped at the total amounts you have paid us for the service in the twelve months before the event giving rise to the claim, which during the free beta is zero.
Nothing in these terms limits or excludes liability that cannot be limited or excluded under Czech law, such as liability for damage caused intentionally or by gross negligence, or for harm to a person’s natural rights.
Data protection
We process personal data as described in our Privacy notice. Where we process workspace content on your behalf as a processor, the terms in our Data processing terms apply.
Termination and suspension
You may stop using the service and close your account at any time. We may suspend or terminate access if you breach these terms, if we reasonably believe suspension is needed to protect the service or other customers, or if we discontinue the beta. On termination your right to use the service ends and we may delete your content after a short wind-down period.
Changes to the terms
We may update these terms as the product evolves. We will communicate material changes by a reasonable means, and your continued use of the service after an update takes effect means you accept the revised terms.
Governing law and venue
These terms are governed by the laws of the Czech Republic. Any dispute arising from or in connection with them will be resolved by the competent courts of the Czech Republic, without prejudice to any mandatory consumer protection rights.
